• Use candidate data for purposes outside of legitimate recruitment activities
• Share or resell access to the platform without authorization

6. User Content and Data

You retain ownership of any content and candidate data you upload to Peoly. By uploading content, you grant Peoly a license to process, store, and display this content solely for the purpose of providing our services to you.

You are responsible for:

• Ensuring you have the right to upload and share candidate information
• Obtaining necessary consents from candidates for data processing
• Complying with applicable data protection laws (GDPR, CCPA, etc.)
• Maintaining the accuracy and legality of your uploaded content

7. Data Privacy and Security

We take data security seriously and implement industry-standard measures to protect your information. However, no system is completely secure. You acknowledge that you use the service at your own risk.

Our collection and use of personal information is governed by our Privacy Policy. By using Peoly, you consent to our privacy practices as described in that policy.

8. Intellectual Property

Peoly and its original content (excluding user-provided content), features, and functionality are owned by Peoly and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any part of the service without our express written permission.

9. Payment and Subscriptions

Certain features of Peoly require paid subscriptions. By subscribing, you agree to:

• Authorize automatic renewal unless you cancel before the renewal date

10. Termination

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. PEOLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the service will be uninterrupted, secure, or error-free. You use the service at your own risk.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEOLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising from or relating to the service shall not exceed the amount you paid us in the twelve months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Peoly and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the service, violation of these terms, or infringement of any third-party rights.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of Spain.
